ማመልከቻ ማስገባት እና ክፍያ መፈጸም ይኖርበታል፡፡ 7. ማየት የተሳናቸው ወይም መሠረታዊ ትምህርት ያላገኙ ደንበኞች የባንኩን አገልግሎት ለማግኝት በሚመለከተው የባንኩ ሰራተኛ ፊት የጣት አሻራ መጠቀም አለባቸው፡፡ ለሕጋዊ ወኪላቸው ካልሆነ በቀር የቼክ ደብተር ፣ ኤሌክትሮኒክ ካርድ ወይም የሞባይል ባንኪንግ አገልግሎት ባንኩ ለእነዚህ ደንበኞች አይሰጥም፡፡ 8. ማንኛውም ስህተት ካለ በባንኩ የሚደረግ ማሻሻያ ወይም ማስተካከያ በአግባቡ እስከተፈረመበት ድረስ ተፈጻሚ እና የጸና ይሆናል፡፡ ባንኩ በስህተት ለደንበኛው የከፈለ እንደሆነ ባንኩ ክፍያውን ተመላሽ እንዲደረግለት ሊጠይቅ እንደሚችል ደንበኛው ተገንዝበዋል፡፡ 9. በባንኩ ዘንድ የሚገኙ መረጃዎች/ሪከርዶች እና ሰነዶች በደንበኛው ሒሳብ ውስጥ የሚገኘውን ትክክለኛ የገንዘብ መጠን እንደያዙ ይቆጠራሉ፡፡ ሆኖም ግን ከዚህ ተቃራኒ የሆነ የይገባኛል ጥያቄ በሚቀርብበት ጊዜ የማስረዳቱ ሸክም የደንበኛው ይሆናል፡፡ 10. ደንበኛው ከዚህ ዓለም በሞት በሚለይበት ጊዜ ሥልጣን ካለው ፍርድ ቤት ለባንኩ በአድራሻው ግልጽ ትዕዛዝ ካልተሰጠ በቀር ባንኩ በሟች ደንበኛ ሥም ተቀምጦ የሚገኝን ማንኛውንም ገንዘብ ለሟች ወራሾች ወይም ለእነርሱ ጠበቃ አይከፈልም፡፡ስለ ደንበኛው ሞት በጽሑፍ በይፋ ለባንኩ ከተገለጸለት ቀን በፊት ባንኩ የሟችን የባንክ ሒሳብ እንዳይንቀሳቀስ የማድረግ ግዴታ የለበትም፡፡ 11. ደንበኛው በቁጠባ ደብተር ላይ እንዲሁም በገቢ/ወጪ ማዘዣ ሰነዶች ጀርባ ላይ በተጻፈው ደንቦች እና ሁኔታዎች ለመገዛት ተስማምቷል፡፡ ባንኩ ለደንበኛው የ30ቀናት ቅድመ ማሳወቂያ በመስጠት እነዚህን ደንቦችና መመሪያዎች ሊቀይር ወይም ሊያሻሽል ይችላል፡፡ ባንኩ አመቺ ነው ብሎ ባለው በማናቸውም መንገድ ለምሳሌ በቅርንጫፎቹ በግልጽ በሚታዩ ሥፍራዎች ማስታወቂያ በመለጠፍ ሊያሳውቅ ይችላል፡፡ II. 1. ሀ. ይህ ከወለድ ነጻ ሒሳብ ደንበኛው የይከፈለኝ ጥያቄ በሚቀርብበት ጊዜ ተመላሽ የሚደረግ ሲሆን ሂሳቡም ምንም አይነት የትርፍና ኪሳራ ክፍፍል አይመለከተውም ፡፡ ለ. ባንኩ በደንበኞች በሚቀርብለት ጥያቄ መሠረት በእንቅስቃሴ ላይ ላሉ ሒሳቦች በየወሩ እንቅስቃሴ ለሌላቸው ሒሳቦች ደግሞ በየስድስት ወሩ የሂሳብ መግለጫ/ስቴትመንት ሊሰጥ ይችላል፡፡ ደንበኞችም በመግለጫው ያለውን ዝርዝር በሒሳባቸው ካለው የገንዘብ መጠን ጋር በማመሳከር ማንኛውም ስህተት ካለ ለባንኩ በሁለት ሳምንት ጊዜ ውስጥ እንዲያሳውቁ ይጠበቅባቸዋል፡፡ ሐ. ሒሳቡ ለስድስት ወራት ምንም ዓይነት እንቅስቃሴ ካላሳየ ሂሳቡ እንቅስቃሴ ወደሌላቸው ሒሳቦች እንዲዘዋወር ይደረጋል፡፡ በዚሁ ሒሳብ ውስጥ ለሶስት ወራት ጊዜ ምንም ዓይነት ገንዘብ የሌለ እንደሆነ ሒሳቡ ይዘጋል፡፡ መ. እንቅስቃሴ በሌለው ሒሳብ ውስጥ የሚገኝ ገንዘብ ከብር 200.00 በታች በሚሆንበት ጊዜ በየስድስት ወሩ ብር 20.00 ተቀናሽ ይደረጋል፡፡በሒሳቡ የሚገኘውን ገንዘብ ብር 20.00 ወይም ከዚያ በታች ከሆነ አጠቃላይ የገንዘብ መጠኑ ወደ ባንኩ ገቢ ተደርጎ ሒሳቡ ይዘጋል፡፡ሒሳቡ በሚዘጋበት ጊዜ ሁሉም ጥቅም ላይ ያልዋሉ የቼክ ቅጠሎች ለባንኩ ተመላሽ መደረግ አለባቸው፡፡ ሠ. ደንበኛው በመጀመሪያ በሒሳብ መክፈቻ ቅጽ ላይ የቼክ ደብተር እንዲሰጠው መጠየቅ አለበት፡፡ ከዚያ በኋላ ግን ደንበኛው ከቼክ ደብተሩ ጋር የተያያዘውን ቅጽ በመሙላት ማመልከት አለበት፡፡ ረ. በቂ ስንቅ ሳይኖር ለራስም ሆነ ለሦስተኛ ወገን ቼክ መጻፍ በሕግ የተከለከለ ነው፡፡ ይህ ህግ ከተጣሰ ባንኩ በብሔራዊ ባንክ ከጊዜ ጊዜ በሚሰጥ መመሪያ መሠረት አስተዳደራዊ እርምጃ ይወሰዳል፡፡ ሰ. ደንበኛው የቼክ ደብተር በጥንቃቄ መያዝ ይጠበቅበታል፡፡ ከዚህ ጋር በተያያዘ ለሚከሰቱ ችግሮች ኃላፊነቱ የደንበኛው ብቻ ነው፡፡ ሸ. በቼክ ላይ ምንም ዓይነት ስርዝ ድልዝ መኖር የለበትም፡፡ ስርዝ ድልዝ ከተደረገ ግን ባንኩ ቼኩን ያለመቀበል እና ተመላሽ የማድረግ ሙሉ መብት ይኖረዋል፡፡ ቀ. ደንበኛው ክፍያ እንዲፈጽም ትዕዛዝ ሰጥቶ ነገር ግነ በዚያ ሒሳብ ውስጥ በቂ ስንቅ ከሌለ በሌላ የደንበኛው ተንቀሳቃሽ ወይም የቁጠባ ሒሳብ ውስጥ እንዲከፈል ትዕዛዝ የተሰጠበትን መጠን የሚሸፍን ገንዘብ ቢኖር እንኳን በደንበኛው በግልጽ ከሌላው የቁጠባ ወይም ተንቀሳቃሽ ሒሳብ እንዲከፈል ለባንኩ በጽሑፍ ፈቃድ ካልሰጠ በስተቀር ባንኩ በቂ ስንቅ ሳይኖር በተሰጠው ቼክ ክፍያ ላይፈጽም ይችላል፡፡ በ. የቼክ ክፍያ እንዲታገድ የሚቀርብ ጥያቄ በጥንቃቄ እና በትኩረት የሚያዝ ጉዳይ ሲሆን፣ ተፈጻሚነት የሚኖረውም የዕግዱ ማሳወቂያ ለባንኩ ሲደርስ ነው፡፡ ሆኖም ግን በስህተት ወይም በማጭበርበር ገንዘቡ ወጪ ቢደረግ፣ ባንኩ ኃላፊነት አይኖርበትም፡፡ ተ. ደንበኛው በእርሱ የተሰጠ ቼክ ክፍያ እንዲታገድ ለባንኩ ቢያሳውቅም ዕገዳው በኢትዮጵያ ሕግጋት እና ደንቦች ወሰን ውስጥ የማይወድቅ ከሆነ፣ ማሳወቂያው በባንኩ ላይ አስገዳጅነት አይኖረውም፡፡ 2. ሀ. የዚህ ሒሳብ አይነት አለማው ገንዘብን በጥንቃቄ ለመጠበቅ ሲባል ሲሆን፣ ባንኩም እንዲህ ባለው ሒሳብ ውስጥ የሚገኘው ገንዘብ በሸሪዐህ ለተፈቀደ ተግባር መጠቀም እንደሚችል ደንበኛው ተስማምቷል፡፡ደንበኛው በቁጠባ ሒሳብ ባስቀመጠው ሒሳብ ላይ ባንኩ ከሚያገኘው ትርፍ ወይም ኪሣራ ድርሻ አይኖረውም፡፡ ለ. ደንበኛው ጥሬ ገንዘብ ወጪ ለማድረግ ከቅርንጫፎች፣ ከኤቲኤም ማሽኖች፣ በሞባይል አማካኝነት ወዘተ… ሊጠቀም ይችላል፡፡ሆኖም ግን ደንበኛው አማራጮችን ለመጠቀም እንደአስፈላጊነቱ የአገልግሎቱ ተጠቃሚ መሆን አለበት፡፡ ሐ. ባንኩ የቁጠባ ደብተር እስከሰጠ ድረስ ደንበኛው ገንዘብ ወጪ ለማድረግ የቁጠባ ደብተሩ ከወጪ ማዘዣ እና ከመታወቂያ ጋር ማቅረብ አለበት፡፡ ገንዘብ ገቢ ወይም ወጪ በሚደረግ ወቅት ገቢ ወይም ወጪ በሚደረገው የገንዘብ መጠን በባንኩ በደንበኞች አገልግሎት ሠራተኛ ማኀተም እና ፊርማ ይሰፍርበታል፡፡ መ. ባንኩ ደንበኛው ያስቀመጠውን ገንዘብ ሙሉ በሙሉ ወይም በከፊል በደንበኛው ጥያቄ ሲቀርብ እንደሚከፍል ያረጋግጣል፡፡ ሠ. በሒሳቡ ውስጥ ምንም አይነት ገንዘብ ከሌለ ባንኩ ሒሳቡን ለመዝጋት ያለው መብት የተጠበቀ ነው፡፡ ረ. የቁጠባ ደብተር ከጠፋ ወዲያውኑ ለባንኩ ማሳወቅ ይገባል፡፡ ምትክ የቁጠባ ደብተር እንዲሰጥ የሚቀርብ ጥያቄ በጽሁፍ መሆን ይኖርበታል፡፡ ሰ. ሒሳቡ ለአንድ ዓመት ያህል ምንም ዓይነት ወጪና ገቢ የማያሳይ ከሆነ እንቅስቃሴ ወደ ሌለው ሒሳብ ይቀየራል፡፡ በዚህ ሒሳብ ውስጥ የሚገኘው የገንዘብ መጠን ብር 25.00 ወይም ከዚያ በታች ከሆነ ሒሳቡ ይዘጋል፡፡ 3. ሀ. ይህ የቁጠባ ተቀማጭ ሒሳብ ያልተወሰነ ጊዜ ቁጠባ ሲሆን፣ አስቀማጩ (ረቡል ማል)፣ ባንኩ (ሙደሪብ) በሒሳቡ ውስጥ የሚገኘው ገንዘብ በሸሪዐህ መርሆዎች መሠረት በሙዳረባህ ውል ያለገደብ ኢንቨስት እንዲያደርግ ፈቃድ ሠጥቷል፡፡ ለ. ገንዘብ ወደዚህ ሂሳብ ገቢ የሚደረገው በባንኩ በራሱ ውሳኔ ኢንቨስት እንዲደረግ ሲሆን፣ የሚገኘው ትርፍ ቀደም ሲል ስምምነት በተደረሰበት ንጽጽር (ሬሾ) መሠረት በባንኩ እና በደንበኛው መካከል ይከፋፈላል፤ ነገር ግን በባንኩ ግዴለሽነት ምክንያት ካልሆነ በስተቀር ኪሣራ ቢደርስ ኃላፊነቱ ሙሉ በሙሉ የደንበኛው ይሆናል፡፡ ሐ. ባንኩ ከጊዜ ወደ ጊዜ ኢንቨስት የሚደረገውን አነስተኛ እና ከፍተኛ የገንዘብ መጠን ይወስናል፡፡ መ.በሙዳረባህ የቁጠባ ሒሳብ ወይም በሌላ ገደብ የሌለው የኢንቨስትመንት ሒሳብ ገቢ የሚደረግ ገንዘብ ገደብ በሌለው ሙዳረባህ መሠረት በአስቀማጮች እና ባለአክሲዮኖች የጋራ ኢንቨስትመንት ኢንቨስት ይደረጋል፡፡ ሠ. በሙዳረባህ የቁጠባ ሒሳብ ውስጥ ተቀማጭ የተደረገው ገንዘብ በባንኩ ሥራ አመራር በሚወሰነው መሠረት ከአነስተኛው ገደብ የሚያንስ በሚሆንበት ጊዜ ሒሳቦቹ እንደ ወዲዐህ ሒሳብ ተቆጥረው ለዚህ ዓይነቶቹ ሒሳቦች ተፈጻሚ የሚሆኑት ደንቦች ገዢ ይሆናሉ፡፡ ረ. በደንበኛው እና በባንኩ መካከል የሚኖረው የትርፍ ክፍፍል ንጽጽር ____________________ ለ___________________ ይሆናል፡፡ ሰ. የኢንቨስትመንት ሁኔታው በሙዳረባህ ቁጠባ ሒሳቦች የገንዘብ መጠን ወይም በተጨባጭ ከተገኘው ትርፍ ላይ ሙደሪቡ በሚያገኘው የትርፍ ድርሻ መቶኛ ላይ ለውጥ እንዲደረግ የሚጠይቅ ከሆነ፣ ባንኩ እነዚህን ለውጦች በቅርንጫፎቹ በማስታወቂያ መልክ ያሳውቃል፡፡ ሸ. በባለአክሲዮኖች እና አስቀማጮች የጋራ ኢንቨስትመንት አማካኝነት የተገኘ ትርፍ ኢንቨስት በተደረገው የገንዘብ መጠን ላይ ባላቸው የዋጋ ድርሻ መሠረት እንዲከፋፈል ይደረጋል፡፡ ቀ. ደንበኛው በሌላ አኳኋን እንዲሆን ካልጠየቀ በስተቀር በሙዳረባህ የቁጠባ ሒሳብ የተገኘ ትርፍ፣ ትርፍ ከሚከፋፈልበት ሩብ ዓመት በኋላ ባለው ወር ከሰላሣ ቀናት ባልበለጠ ጊዜ ውስጥ ወደ ደንበኛው ሒሳብ ውስጥ ገቢ ይደረጋል፡፡ በ. ባንኩ ሙደሪብ እንደመሆኑ መጠን በጋራ ኢንቨስትመንት ከተገኘ የተጣራ ትርፍ የራሱን ድርሻ ከቀነሰ በኋላ ለደንበኛው ጥቅም ሲባል ብቻ ሊያጋጥሙ ለሚችሉ ስጋቶች ከደንበኛው ትርፍ ላይ የተወሰነ መቶኛ መጠን ተቀናሽ የማድረግ መብቱ የተጠበቀ ነው፡፡ እንዲህ ያለው ገንዘብ ተቀናሽ የሚደረገው፣ የሚያዘው እና የሚከፋፈለው በባንኩ የሸሪዐህ አማካሪ ኮሚቴ ፈቃድ ሲገኝ ብቻ ይሆናል፡፡ ተ. ባንኩ ሙደሪብ እንደመሆኑ መጠን የባለአክሲዮኖች እና የአስቀማጮችን ጥቅሞች ለማረጋጋት ሲል በጋራ የኢንቨስትመንት ገንዘብ ከተገኘ የተጣራ ትርፍ ላይ የሙደሪቡን ድርሻ ከመቀነሱ በፊት ከባለአክሲዮኖች እና አስቀማጮች የትርፍ ድርሻ ላይ የተወሰነ መቶኛ መጠን የመቀነስ መብቱ የተጠበቀ ነው፡፡ እንዲህ ያለው ገንዘብ ተቀናሽ የሚደረገው፣ የሚያዘው እና የሚከፋፈለው በባንኩ የሸሪዐህ አማካሪ ኮሚቴ ፈቃድ ሲገኝ ብቻ ይሆናል፡፡ Section Buttons TERMS AND CONDITIONS FOR INTEREST FREE BANKING ACCOUNT OPENINGS I.GENERAL TERMS AND CONDITIONS 1. These terms and conditions shall be construed and implemented pursuant to the Laws of Ethiopia, the directives and regulations of National Bank of Ethiopia, Dashen Bank's (DB) Memorandum and Articles of Association, DB's policies & procedures and Fatawa & the provisions of DB's Shari'ah Advisory Committee. 2. It is not allowed to open and operate the account with income generated from business activity such as interest, usury, gambling and similar chance games, pork, alcohol, pornography and other incompatible business with the principle of Interest Free Banking. In a situation where the Bank identified such income sources used for account operation, the Bank has the right to close the account and fine with cash. 3. The Customer's signature specimen registered with the Bank, shall be considered to be the basis of carrying out transactions on his/ her/its accounts, and shall be valid unless modified or cancelled by the request of the customer. 4. Should the Customer wants to change his/ her /its name for any reason, then the Customer shall produce a document issued by the concerned authority indicating its approval of the change of the name. 5. The Bank, without referring to the Customer, may deduct from the Customer's account expenses, fees or commissions payable against the banking services rendered to the Customer according to banking fees and commissions regulations approved by the Bank. 6. The Bank shall have the right to destroy cheque books, Electronic Cards, Personal Identification Numbers in the event the Customer didn't receive them after Six months (at the latest) of its issuance date. The Customer has to submit new application and to pay the due fees in order to re-issue any of such services. 7.The blind or illiterate Customer shall process their transactions before the concerned officer in the Bank by using fingerprint and seal (if any). In order to protect the interest of the blind/illiterate Customer, the Bank shall not issue any cheque books, Electronic Card, or telephone-banking service for them, except through an official proxy. 8. In case of an error in the entries, any amendment or correction made to the entries duly signed by the Bank shall be deemed effective and valid. The Customer acknowledges that the Bank has the right to recover from him/her/it the amounts that has been paid to him/her/it in error. 9. The records and documents at the possession of the Bank shall be considered as an evidence of the correctness of the customer's balance. If, however, the contrary is claimed, then the burden of proof shall lay with the Customer. 10. In the event of the Customer's death, his/her account shall be frozen and no amount whatsoever available in the Customer name held by the Bank shall be paid to the Customer's heirs or their attorney unless there is an official request from the competent court addressed to the Bank to that effect. The Bank shall not be obliged to freeze the account before the date on which it has been formally notified of the death in writing. 11. The client agrees to be bound by these terms and conditions and further is bound by the conditions printed on the passbook and on the back of the deposit /withdrawal slips. The Bank reserves the right to amend the terms and tariffs by giving 30 days notice to the client. The Bank may notify in any manner which it may deem proper including by posting notice in conspicuous places of its Branches. II.SPECIAL TERMS AND CONDITIONS 1.Qard Current Account (a) It is an interest - free call deposit account that is governed by the rules applied to loans with respect to guarantee to repay an equal amount on demand. It does not participate in investment profit nor bear risks. (b) The Bank at the request of the client may provide statement on monthly and every six months for active and inactive accounts, respectively, against which customer are expected to reconcile their account balance and inform the bank within two weeks time if variation prevail (c) If the account does not show any movement for six months, the amount will be considered as dormant and be transferred to inactive accounts. If the account shows zero balance for 3 consecutive months, the account will be closed. (d) If the balance in inactive account is less than birr 200, a charge of birr 20 will be deducted at the end of every six months and if the balance is birr 20 or less, the whole balance thereof will be charged and the account will be closed. Up on closure of the account unused cheques should be returned to the bank (e) Initially the Client has to apply for cheque Book in account opening application form. From next time on Client has to apply using the application form attached to the cheque book. (f) It is legally prohibited to write a check payable to self or third party without sufficient funds. Whenever there is a violation of this provision, the Bank is obliged to take administrative measures as prescribed by the National Bank of Ethiopia from time to time. (g) The Customer shall take due care of his/her/its cheque book and shall assume full responsibility thereof. (h) No alteration shall be made on cheque .If it happens the bank is in absolute discretion to dishonor or return any form of alteration. (i) The Bank may refuse to pay the amount of the cheques drawn on the Customer's account if there is no sufficient funds regardless of the fact that other accounts of the same Customer may be in credit balance, unless he/she/ it authorizes the Bank in writing to cover the cheque amounts or any other withdrawals from its other current or saving accounts with the Bank. (j) Stop payment of cheque is taken under notification with proper caution and attention and it shall be effective up on the receipt by the bank but if payment is made by mistake/ fraudulent withdrawal is made then the bank cannot be held responsible. (k) The Customer instructions to stop the payment of cheques issued by him/her/ it shall not be binding, unless such instructions fall within the scope of applicable laws and regulations in Ethiopia. 2.Wadiah Saving Accounts (a) Deposit is taken in the account for safekeeping purpose and the client agrees that Bank can use the deposit for permitted activities in accordance with the Shari'ah. Client will not have any share in the profit or loss for his/her deposit. (b) Cash withdrawal is possible through any of the Bank's designated channels like Branches, ATMS, mobile … etc as per the Clients preferences provided the Client has subscribed to those delivery channels. (c) Passbook presentation together with withdrawal voucher at the time of withdrawal is required in as long as the Bank issues a passbook and subject to production of proof of identity (ID card) for withdrawal. The amount entered at the time of operation, i.e., deposits or withdrawals will be dully stamped and initialed by the Customer Service Officer of the bank. (d) The bank guarantees the payment of the whole amount of the deposits or any part when demanded by the depositor. (e) If the account reaches with zero balance the bank shall have the right to close the account. (f) In the event of loss of passbook, it should be immediately reported to the bank. A request for its replacement is to be accompanied by a written and signed statement to that effect. (g) If the account does not show any movement for one year, it will be considered as inactive account. If such account shows Birr 25 or lesser amount, the account will be closed. 3. Mudarabah Savings Deposit Account (a) It is a deposit for unlimited period whereby the depositor (Rab ul mal) authorizes the Bank (Mudarib) to invest the funds on the basis of unrestricted Mudarabah contract in accordance with principle of Shari'ah. (b) Deposit is taken in the account for purpose of investment by the Bank, at its own discretion, to share the profit in accordance with the pre-agreed ratio while any loss will be borne by the client unless the occurrence is due to negligence of the Bank. (c) The Bank, from time to time, determines the minimum and maximum amount to be invested. (d) Funds of Mudarabah savings deposit account and other un-restricted investment deposit accounts shall be invested on unrestricted Mudarabah basis in the joint investment pool amongst the depositors and the shareholders. (e) In case the deposited amount in the Mudarabah savings account was less than the specific limit, which is determined by the Bank's management, then the accounts shall be treated as a wadiah account and its governed rules. (f) The profit sharing ratio between the Client and the Bank is ______ to _______, respectively. (g) If the investment circumstance requires change the investment weightages of the Mudarabah savings accounts balances or Mudarib's percentage of the realized net profit, then the bank shall display such change at the Bank's branches. (h) The net profits of the joint investment pool shall be distributed amongst shareholders and depositors according to their respective weightages in the invested funds (I) Profits of Mudarabah savings account shall be credited to the Customer's account within a period not exceeding thirty days of subsequent month following the yearly quarter for which the profit is being distributed unless the Customer had requested otherwise. The Bank as Mudarib, reserves the right to deduct a certain percentage of the depositors net Profit in the joint investment pool after deducting the Mudarib's share in order to hedge against investment risk solely for the benefit of the depositors. Such funds shall be deducted, held and distributed only upon the prior approval of the Bank's Shari'ah Advisory Committee, (k) The Bank, as Mudarib, reserves the right to deduct a certain percentage of the shares of both, shareholders and depositors from the net Profit in the joint investment pool, before deducting Mudarib's share for the purpose of Profit stabilization for the benefit of shareholders and depositors.
